1. Scope and provider
These Terms govern use of Kim Tài - Tick Vàng Online, provided by the operator pending legal configuration. Registration number: to be published before release. The Privacy Policy is a separate document. Accepting these Terms does not by itself constitute consent to personal-data processing.
2. Acceptance and review
You become bound only after the Terms are presented clearly and you take the acceptance action required by the App, to the extent permitted by law. You must have a reasonable opportunity to read, download, or retain the current version.
If you do not agree, do not continue using the App. Acceptance of these Terms does not replace separate consent for personal-data processing where consent is legally required.
The operator retains the version of the Terms you accepted for the period in which they remain effective and, as required by applicable law, provides a copy within seven working days after receiving a valid request. The time, version, and method of acceptance may be recorded as evidence of formation.
3. The service
The App helps record a personal gold portfolio, display estimated values, view reference buy/sell prices by source, and personalize language, unit, or reminder settings.
The App is not an exchange or custodian. It does not buy or sell gold, set transaction prices, or provide investment, tax, or legal advice.
4. Reference prices and third-party sources
Prices, timestamps, provider names, and estimates are for reference only. Data may be delayed, incomplete, or different by region, product, or source conditions.
Confirm directly with the relevant gold business before making a transaction decision. Displaying a source name does not by itself indicate agency, sponsorship, or endorsement between that source and Kim Tài.
5. On-device data and backups
Under the current product design, portfolio information you enter is stored on the device. You are responsible for protecting the device, maintaining suitable backups, and checking data before uninstalling the App, changing devices, or resetting the device.
Functions such as fetching reference prices, opening an app store, or contacting support may require a network connection and may be subject to third-party policies. See the Privacy Policy for data-processing details.
6. Permitted use
You may use the App for personal, lawful purposes and in line with its documentation.
Do not disrupt, damage, probe without authorization, or bypass safeguards protecting the App or related services.
Do not copy, resell, rent, commercially exploit, or create derivative products from the App without a lawful right.
Do not use the App to provide deceptive information, infringe another person's rights, or perform prohibited acts.
7. Updates and availability
We may update, suspend, or change functions to fix defects, protect security, or comply with law. If a change materially affects your rights, we will provide reasonable notice and seek renewed acceptance where required.
No promise is made that every price source or function will always be available. Mandatory consumer rights remain unaffected.
You may stop using and uninstall the App at any time. A change to general transaction conditions does not bind you unless it has been notified or accepted as required by law; if you disagree, you may terminate without losing rights already accrued.
8. Intellectual property
The App, interface, source code, Kim Tài-created content, and related marks are protected by applicable law. Portfolio data you enter remains yours; rights to use that data arise only as needed to deliver functions you request and as described in the Privacy Policy.
9. Responsibility and consumer rights
To the extent permitted by law, we are not responsible for decisions to buy, sell, or hold gold based on reference data, or for data loss caused by a lost, damaged, reset, or erased device outside our reasonable control.
Nothing in these Terms excludes liability that cannot lawfully be excluded, restricts complaint or court rights, or reduces mandatory consumer protections under Vietnamese law. Ambiguities are interpreted in the consumer's favor where applicable.
10. Governing law, complaints, and language
These Terms are governed by Vietnamese law. Complaints may be sent through https://www.facebook.com/profile.php?id=61592343291824; the parties should first seek a good-faith resolution without limiting either party's right to approach a competent authority or court.
The Vietnamese version is used to interpret and apply this document. However, if the Vietnamese and English versions differ and applicable law requires the version more favorable to the consumer to prevail, the more favorable wording applies.
